Terms of Service

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY:

Theirmusic.com (“TMC”), owned, produced and operated by Apex Partners, Inc. (“Apex Partners”) and, potentially, in part or in whole, by its parents, subsidiary and affiliate corporations, successors, and assigns (collectively referred to as “Apex Partners Companies”). TMC is a music-oriented content, media and information website that provides a service to musical artists, the general public, entertainment industry representatives and third party vendors. On behalf of musical artists (each an “Artist” and collectively “Artists”) posting information regarding themselves as well as musical content or media owned and/or created by them, unless explicitly stated otherwise, any current, updated and new products and services, including the addition of new properties shall be subject to these General Terms and Conditions of Use (“Terms of Service”).

As a vendor of "TMC' vendor services you agree to the following:

1. Protecting the privacy of the users information submitted to you via our automated e-mail format/vendor center
2. You will not sell, transfer, or otherwise provide said users information to a third party for monetary reasons
3. Contact said users within a timely fashion with the requested information of said users inquiry
4. Notify 'TMC' of user abuse ie: falsified submissions or prank inquires
5. Deliver said products/service within the specified time agreed upon between you and said user
6. Deliver commisions due 'TMC' for business conducted/completed with user/s as soon as user/s has paid said vendor
7. Commission will be paid to 'TMC' by way of online transfers to "Apex Partners" pay pal account
8. Commsions due are based on per job/task and will be treated as such

Agreed Commision Structure:

In consideration for the referals/submission's and revenue generated by procureing and closing a business deal and the sale of and payment made by a user generated with the use of "TMC's" musicians hub referal service center you agree to pay "Apex Partners" the following commision:

Sales/Payments equal to the following amounts:
$1.00 - $500.00 = 8% commision
$501.00 - $2000.00 = 6% commision
$2001.00 - $5000.00 = 4% commision
$5001.00 - $10,000.00 = 3% commision
$10,001.00 - And Up = 2% commision

Use of the Vendor Main Stage Services is subject to compliance with these Terms and Conditions. You shall be authorized to use the Vendor Main Staging area for commercial use. You acknowledge and agree that "Apex Partners" may terminate your access to the Vendor Main Staging area should you fail to comply with the Terms and Conditions or any other guidelines and rules published by "Apex Partners". Any such termination shall be in "Apex Partners" sole discretion and may occur without prior notice, or any written notice.

"Apex Partners" reserves the right to refuse service, offered by the TMC website and any of it's subsidiaries or affiliates."Apex Partners" reserves the right, at its sole discretion, to change, modify or otherwise alter these terms and conditions at any time. Such changes and/or modifications shall become effective immediately upon the posting thereof. Please review the terms and conditions periodically. Your continued use of the TMC website following the posting of changes and/or modifications will constitute your acceptance of the revised terms and conditions.

You acknowledge and agree that "Apex Partners" and its designees shall have the right (but not the obligation), in their sole discretion, to refuse to publish, remove, or block access to any Content that is available via Vendor Services at any time, for any reason, or for no reason at all, with or without notice. Without limitation "Apex Partners" and its designees shall have the right (but not the obligation), in their sole discretion, to refuse to publish, remove, or block access to any Content that violates the Terms and Conditions or is otherwise objectionable as determined by "Apex Partners", in its sole discretion. "Apex Partners" may also terminate access to, or membership in, TMC, or any portion thereof, for violating these Terms and Conditions. You acknowledge and agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content.

REGISTRATION AND PRIVACY

Certain areas of the Vendor Services provided by the TMC web site requires our vendors to register and provide certain data. In consideration of use of such Services and referals, in registering and providing such data, you represent and warrant that: (a) the information about yourself is true, accurate, current, and complete (apart from optional items) as required by various "Apex Partners" registration forms and (b) you will maintain and promptly update the Indexed Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or "Apex Partners" has a reasonable ground to suspect that such information is untrue, inaccurate, not current or incomplete, "Apex Partners" has the right to suspend or terminate your account and refuse any and all current or future use of the Vendor Services Area. "Apex Partners" and TMC collects vendor submitted information such as name, mailing address, email address, telephone number to authenticate said vendor and to send notifications to said vendor relating to, without limitation, TMC services, special events, contests and special offers that said vendor may or may not be invited to participate in.

In addition "Apex Partners" uses pixel tags for the purpous of gathering information as to what parts of our website have been visited or to measure the effectiveness of searches users perform on our website. Pixel tags also enable us to send email messages in a format where customers can read and they tell us whether emails have been opened to assure that we’re only sending messages that are of interest to our vendors. "Apex Partners" stores all of this information on secure (SSL) servers and databases.

"Apex Partners" and or TMC may also use a vendors email address to send updates, newsletters or news regarding the services offered/change. "Apex Partners" and or TMC may send email messages which use a “click-through URL” linked to content on the TMC website. They are only used as a re-direct to the vendor main stage area or other parts of our website.

"Apex Partners" its subsidiaries or affiliatesis will be held harmless inrespect to the quality of delivery of the products or services offered or advertised by said vendors and accessed, obtained by said user/s . As such, neither "Apex Partners", its subsidiaries or affiliates will be held responsible for any errors or omissions or for the results obtained from the use of our vendor services area.

Disclaimers and Limitations on Liability

"Apex Partners" IS PROVIDING THE CONTENT ON THIS WEBSITE ON AN "AS IS" BASIS. "Apex Partners" MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AND SPECIFICALLY DISCLAIMS ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOUS, TITLE OR NON-INFRINGEMENT OR ANY WARRANTY ARISING BY USAGE OF TRADE, COURSE OF DEALING OR COUSE OF PERFORMANCE. IN ADDITION, "Apex Partners"DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION ACCESSIBLE VIA THIS SITE IS ACCURATE, COMPLETE OR CURRENT. INFORMATION IS SUBJECT TO CHANGE WITHOUT NOTICE. FURTHER "Apex Partners" DOES NOT WARRANT THAT ACCESS TO TMC WILL BE UNINTERUPTED OR ERROR-FREE.IN NO EVENT SHALL "Apex Partners" BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, FOR LOST PROFITS, LOSS OF ADVANTAGE, LOSS OF SAVINGS, LOSS OF REVENUES OF ANY KIND, INCREASED COSTS OF OPERATION, BUSINESS INTERRUPTION OR LOSS OF INFORMATION, EVEN IF TMC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES
